Terms of Use

These Terms of Use govern your access to and use of PaceMyPlate, which is operated by Stelios Andreou trading as Pace My Plate, ABN 50 417 208 715. They apply to the mobile application, website, account sync, meal and activity planning features, and paid subscriptions.

By creating an account, purchasing a subscription, or otherwise using PaceMyPlate, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 years old to use PaceMyPlate. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to your use of the app. You must be legally capable of entering these Terms in your location.

2. Nutrition information, not medical advice

PaceMyPlate provides general educational and planning information. It is not medical advice, a medical device, a substitute for professional care, or a tool for diagnosing, treating, curing, or preventing any condition.

Calculations and recommendations are estimates based on the information you enter and general formulas. Individual energy requirements and responses vary. Results may be incomplete, unsuitable, or inaccurate for you.

Consult a qualified health professional before making material dietary or weight-management changes, particularly if you are pregnant or breastfeeding, under 18, have an eating disorder or history of disordered eating, take medication, have diabetes or another medical condition, or have specialised nutritional needs.

Do not use PaceMyPlate for emergencies. Seek urgent medical assistance if you believe you may be experiencing a medical emergency.

3. Your account

You are responsible for providing accurate information, protecting your device and sign-in credentials, and all activity under your account. Notify us promptly if you suspect unauthorised use.

Sign-in may be provided by Apple, Google, or another supported authentication provider. Your use of those services is also subject to their terms.

4. Acceptable use

You must not:

  • use PaceMyPlate unlawfully or to harm another person;
  • interfere with the service, security controls, accounts, or infrastructure;
  • scrape, copy, reverse engineer, or extract substantial parts of the service except where applicable law permits;
  • introduce malicious code or attempt unauthorised access;
  • misrepresent your identity or use another person's account without permission; or
  • use the app to provide medical or dietetic services while representing PaceMyPlate output as professional advice.

5. PaceMyPlate Pro subscriptions

Paid features may be offered through automatically renewing monthly or annual subscriptions. The paywall displayed before purchase will show the product, billing period, price, included features, and any trial or introductory offer available to your Apple account.

Payment is charged to your Apple account when you confirm the purchase. Unless cancelled, a subscription automatically renews for the same period at the then-current price. Apple generally charges renewal within 24 hours before the current period ends.

You can manage or cancel your subscription in your Apple account settings. Cancellation takes effect at the end of the paid period. Removing the app or deleting your PaceMyPlate account does not cancel an Apple subscription.

Purchase restoration is available in the app. RevenueCat helps PaceMyPlate verify purchases and manage feature entitlements, while Apple processes payment and controls App Store billing.

6. Trials, refunds, and billing issues

Trial eligibility and duration are shown before purchase. Unless you cancel before a trial ends, it may convert to a paid subscription at the displayed price.

Apple handles App Store charges and refund requests. You may request a refund through Apple, subject to its policies and your rights under applicable consumer law. PaceMyPlate cannot directly issue an App Store refund.

7. Changes to features and prices

We may improve, add, remove, or modify features. We may also change subscription pricing or plans. Material subscription changes will be handled through the App Store process and any notice or consent required by Apple or applicable law. We do not guarantee that every feature will always remain available.

8. Your content and feedback

You retain ownership of information and content you enter into PaceMyPlate. You grant us a limited licence to host, process, reproduce, and transmit that content only as reasonably necessary to operate, secure, and improve the service.

If you voluntarily provide product feedback or suggestions, we may use them without restriction or payment, provided we handle associated personal information in accordance with the Privacy Policy.

9. Our intellectual property

PaceMyPlate, its software, interface, visual design, text, databases, planning logic, and branding are owned by or licensed to Stelios Andreou trading as Pace My Plate and are protected by applicable intellectual-property laws. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose.

10. Third-party services

PaceMyPlate relies on services provided by Supabase, PostHog, RevenueCat, Apple, Google, and potentially other suppliers. Third-party services may be unavailable, change their terms, or process information under their own privacy policies. We are not responsible for third-party services outside our reasonable control.

11. Suspension and termination

You may stop using PaceMyPlate at any time. You may request account deletion by contacting pacemyplate@gmail.com until secure in-app deletion is available.

We may suspend or terminate access where reasonably necessary to address serious or repeated breaches of these Terms, unlawful conduct, security risks, non-payment, or harm to the service or other users. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.

12. Availability and disclaimers

We aim to provide a reliable service, but PaceMyPlate may contain errors or experience interruptions. To the maximum extent permitted by law, the service is provided on an "as available" basis, without guarantees that it will be uninterrupted, error-free, or suitable for every user or purpose.

13. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the extent permitted by law, PaceMyPlate and its operator are not liable for indirect, incidental, special, or consequential loss, loss of data, loss of opportunity, or loss arising from reliance on estimated nutrition or activity information.

Where liability for a service can lawfully be limited, our liability is limited, at our option, to supplying the service again or paying the reasonable cost of having the service supplied again.

14. Apple-specific terms

These Terms are between you and Stelios Andreou trading as Pace My Plate, not Apple. Apple is not responsible for PaceMyPlate or its content and has no obligation to provide maintenance or support.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you. Your use of the iOS app must also comply with the App Store Usage Rules.

15. Changes to these Terms

We may update these Terms as the service or law changes. The current version will be published here with a revised effective date. If a change is material, we will provide reasonable notice and request renewed agreement where required.

16. Governing law

These Terms are governed by the laws of Queensland, Australia. Courts with jurisdiction in Queensland may hear disputes, subject to any mandatory rights you have under the law of your location.
